{"id":5937,"date":"2018-11-05T22:21:06","date_gmt":"2018-11-06T03:21:06","guid":{"rendered":"http:\/\/www.khpi.org\/blog\/?p=5937"},"modified":"2018-11-11T16:19:09","modified_gmt":"2018-11-11T21:19:09","slug":"another-st-joseph-london-cardiologist-is-sentenced-to-prison","status":"publish","type":"post","link":"http:\/\/www.khpi.org\/blog\/another-st-joseph-london-cardiologist-is-sentenced-to-prison\/","title":{"rendered":"Another St. Joseph- London Cardiologist Is Sentenced to Prison."},"content":{"rendered":"<h6><span style=\"color: #000000;\">Could this have been averted early on before this unfortunate result?<\/span><\/h6>\n<p><span style=\"color: #000000;\">Last week, following his <a href=\"http:\/\/www.khpi.org\/blog\/second-cardiologist-found-guilty-in-federal-court-for-performing-unnecessary-cardiac-procedures-at-st-joseph-london-hospital\/\" target=\"_blank\" rel=\"noopener\">conviction last April<\/a> for medical billing-fraud related to medically unnecessary placement of cardiac pacemakers, Dr. Anis Chalhoub was sentenced to 42 months in prison; required to pay $257,515 restitution to Medicare, Medicaid, and private insurers; and fined an additional $50,000.<span class=\"Apple-converted-space\">\u00a0 <\/span>Dr. Chaloub&#8217;s attorneys had requested a shorter time in prison and perhaps it is possible they will appeal the sentence.<\/span><\/p>\n<p><span style=\"color: #000000;\">According to the <a href=\"https:\/\/www.justice.gov\/usao-edky\/pr\/london-cardiologist-sentenced-42-months-health-care-fraud\" target=\"_blank\" rel=\"noopener\">press release<\/a> from the U.S. Attorney\u2019s Office, an additional term in the sentence was that following release from prison he will remain on probation for a three-year period during which the \u201ccourt has prohibited him from practicing cardiology during that time.\u201d<span class=\"Apple-converted-space\">\u00a0 <\/span>I am puzzled about whether a federal court has superior jurisdiction over Kentucky\u2019s Medical Licensure Board for such a restriction on licensure.<span class=\"Apple-converted-space\">\u00a0 <\/span>If I were the Kentucky Board, I would be embarrassed or angry, or both.<span class=\"Apple-converted-space\">\u00a0 <\/span>Out of curiosity, I looked today at the Kentucky Board\u2019s <a href=\"https:\/\/kbml.ky.gov\/physician\/Pages\/Physician-Profile-Verification-of-Physician-License.aspx\" target=\"_blank\" rel=\"noopener\">website<\/a> which informs me and potential patients that Dr. Chalhoub still has an active Kentucky medical license with \u201cno actions\u201d or restrictions mentioned. (I confirmed this with a call to the Board.)<span class=\"Apple-converted-space\">\u00a0 <\/span>Although several physician-referral &amp; rating websites have him affiliated with hospitals in Lousiville and Indiana, I do not know if he is still practicing medicine.<\/span><!--more--><\/p>\n<p><span style=\"color: #000000;\">The government&#8217;s case against Dr. Chalhoub has been chugging along since his <a href=\"http:\/\/www.khpi.org\/blog\/wp-content\/uploads\/2018\/11\/chalhoub-indictment.pdf\" target=\"_blank\" rel=\"noopener\">indictment<\/a> in June 2016\u2013<span class=\"Apple-converted-space\">\u00a0 <\/span>as have civil lawsuits for malpractice. Despite the passage of time and a presumed abundance of courtroom and settlement documents, I did not personally have a sense of the magnitude of the putative deviations from medical practice norms alleged to have taken place. I have written in the past about how the nature of trial and settlement agreements makes it difficult for the public to know what actually has happened in these healthcare cases, or what individuals or institutions have shared any role. A more rigorous on-line search for court documents today found one relevant document that helped.<span class=\"Apple-converted-space\">\u00a0 <\/span>In his August 1, 2018 <a href=\"http:\/\/www.khpi.org\/blog\/wp-content\/uploads\/2018\/11\/denial-motion-to-acquit-aug2018.pdf\" target=\"_blank\" rel=\"noopener\">decision not to acquit<\/a> Dr. Chalhoub of his conviction or to grant him a new trial, Federal Judge Gregory F. VanTatenhove summarizes enough of the factual evidence and expert testimony from last April\u2019s trial for me to believe that the jury\u2019s verdict was a justifiable and proper one.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\">Interestingly, Dr. Chalhoub\u2019s defense followed the example piloted by Dr. Richard E. Paulus in an initially successful move to reverse his conviction for billing-fraud and angioplasty abuse at King\u2019s Daughters Medical Center. That defense claimed that because of the subjectivity and difficulty in making medical judgements that it is impossible to be accused of making false statements.<span class=\"Apple-converted-space\">\u00a0 <\/span>That argument was dismissed both by Judge VanTatenhove, and earlier by the Sixth Circuit Court of Appeal in their <a href=\"http:\/\/www.khpi.org\/blog\/wp-content\/uploads\/2018\/11\/paulus-appeals-decision-apr2018.pdf\" target=\"_blank\" rel=\"noopener\">highly critical reversal<\/a> of the earlier <a href=\"http:\/\/www.khpi.org\/blog\/wp-content\/uploads\/2018\/11\/district-court-acquital-mar2017.pdf\" target=\"_blank\" rel=\"noopener\">district court acquittal<\/a> of Dr. Paulus rejecting the argument as \u201can insult to common sense.\u201d<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\">Dr. Chalhoub deserves to be treated fairly, as does any defendant in our court system. A review of at least some of the titles of more than <a href=\"https:\/\/www.courtlistener.com\/docket\/4268411\/united-states-v-chalhoub\/\" target=\"_blank\" rel=\"noopener\">166 court documents<\/a> tells that he had a hard-fought defense and at probably more than customary due-process throughout his personal ordeal.<span class=\"Apple-converted-space\">\u00a0 <\/span>He was convicted and sentenced for billing-fraud for exaggerating the severity of illness of his patients in order to gain higher reimbursement than he was due. In my mind he was also guilty of taking advantage of his patients for personal gain by not providing accurate and fully informed consent.<\/span><\/p>\n<p><span style=\"color: #000000;\">With respect to Dr. Chalhoub\u2019s case and others involving over-utilization of invasive cardiac procedures <a href=\"http:\/\/www.khpi.org\/blog\/second-cardiologist-found-guilty-in-federal-court-for-performing-unnecessary-cardiac-procedures-at-st-joseph-london-hospital\/\">I offered<\/a> that: \u201c<b>What I \u2026 believe is that when lawmakers, lawyers, and judges have to step in to ensure that appropriate medicine is being practiced, that we have failed our mutual professional responsibility as physicians.\u201d<\/b><span class=\"Apple-converted-space\">\u00a0 <\/span>I do not know if Dr. Chalhoub\u2019s practices were evaluated under the auspices of the Board of Medical Licensure or if any action was taken by the Board that is otherwise not available to the public.<span class=\"Apple-converted-space\">\u00a0 <\/span>The Board responded to an inquiry from <a href=\"https:\/\/www.thenewsjournal.net\/tag\/healthcare-fraud\/\" target=\"_blank\" rel=\"noopener\">The News Journal<\/a> of Whitley County\u2013 \u201cWhile they could not comment on a specific case, board officials said if a physician is found guilty of a felony, the board may elect to take disciplinary action.\u201d<span class=\"Apple-converted-space\">\u00a0 <\/span>Should the Board wait that long? Would earlier inquiry or intervention have been more fair to both parties?<span class=\"Apple-converted-space\">\u00a0 <\/span>To the public?<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\">In my understanding, the Kentucky Board of Medical Licensure has two primary responsibilities which are inevitably in conflict with each other. On one hand it has statutory responsibility to protect the safety of the public. On the other hand however, it is organized and acts to protect the professional and commercial<\/span><span class=\"Apple-converted-space\" style=\"color: #000000;\">\u00a0 <\/span><span style=\"color: #000000;\">interests of us medical professionals\u2013 including the specific interests of the Kentucky Medical Association which in my opinion exercises overlarge influence on the Board. I freely admit that this is not always an easy balance to make.<\/span><span class=\"Apple-converted-space\" style=\"color: #000000;\">\u00a0 <\/span><span style=\"color: #000000;\">Other physicians and individuals will have different feelings, but I believe the Board can better honor its obligation to the public by earlier review and intervention in disputes such as presented in these cases.<\/span><span class=\"Apple-converted-space\" style=\"color: #000000;\">\u00a0 <\/span><span style=\"color: #000000;\">I would like to believe there is a better way to protect the public than waiting for whistleblowers to come forward or for courts to make the tough calls for us. <\/span><span class=\"Apple-converted-space\" style=\"color: #000000;\">\u00a0 <\/span><span style=\"color: #000000;\">In an increasingly disjointed and complicated clinical environment of collaborative team care, all of us physicians should feel a collective obligation to refer significant<\/span><span class=\"Apple-converted-space\" style=\"color: #000000;\">\u00a0 <\/span><span style=\"color: #000000;\">instances of inappropriate care or physician impairment to our local institutional quality and peer review committees\u2013 or if necessary even to the Board of Medical Licensure.<\/span><span class=\"Apple-converted-space\" style=\"color: #000000;\">\u00a0 <\/span><span style=\"color: #000000;\">We have been historically reluctant as a body to do so.<\/span><span class=\"Apple-converted-space\" style=\"color: #000000;\">\u00a0 <\/span><span style=\"color: #000000;\">Would the current opioid epidemic have exploded so badly if we had done our duty?<\/span><span class=\"Apple-converted-space\"><span style=\"color: #000000;\">\u00a0 Did St. Joseph really have to lose its cardiology program and\u00a0<span style=\"caret-color: #000000;\">incur<\/span>\u00a0such damage to its reputation?
